1. Overview

This website, shop.devkota.world, is operated by DEVKOTA ("we", "us", "our"). By browsing the site or placing an order, you agree to these Terms of Service together with our Refund Policy, Shipping Policy and Privacy Policy. If you don't agree, please don't use the site or place an order.

2. Orders

When you place an order, you're offering to buy the items in your cart. Your order is accepted when we send you an order confirmation email. We may decline or cancel an order, in full or in part, for example if an item sells out, a price was listed in error, or we suspect fraud. If we cancel after you've paid, you'll get a full refund.

Stock is limited. We may limit how many units one person, household or payment method can buy.

3. Pre-orders

Pre-order items are charged in full at checkout, together with shipping. The estimated ship date is shown on the product page, at checkout and on your order. Ship dates are estimates, not guarantees.

If we can't ship by the estimated date, we'll email you a revised date. You can then cancel for a full refund at any time before your order ships. If we can't fulfil a pre-order at all, we'll refund you in full.

4. Prices and payment

Prices are in US dollars unless shown otherwise at checkout. Prices can change at any time, but a change won't affect an order we've already confirmed. Sales tax is added at checkout where required. Payments are processed securely by Shopify and its payment partners; we never see or store your full card number.

5. Shipping, customs and duties

Shipping costs are shown and charged at checkout. Delivery times and lost or damaged packages are covered in our Shipping Policy. International orders may be charged customs duties, import taxes or fees by the destination country. These aren't included in the price or shipping cost and are the customer's responsibility.

6. Returns and refunds

All vinyl sales are final, except for damaged, defective or wrong items. The full details, including merch returns, are in our Refund Policy.

7. Product information

We try to show products, colours and artwork as accurately as possible. Mockups and photos are for illustration, and the final product may vary slightly in colour or finish depending on pressing, printing and your screen.

8. Intellectual property

The music, artwork, photos, logos, the DEVKOTA name and everything else on this site belong to DEVKOTA or its licensors and are protected by copyright and trademark law. Buying a record or merch gives you the item itself, not any right to copy, sell, broadcast or otherwise reuse the music, artwork or brand.

9. Emails and marketing

We'll email you about your order. We'll only send marketing emails or texts if you've agreed to receive them, and you can unsubscribe at any time using the link in any marketing message.

10. Acceptable use

Please don't use the site for anything unlawful, to place fraudulent orders, to buy in bulk with bots or automated tools, to interfere with the site's security or operation, or to copy content from it for commercial use. We may cancel orders or block access if these Terms are broken.

11. Third-party services

The store runs on Shopify, and payments, shipping and some features are provided by third parties. Their own terms and privacy policies apply to how they handle your information.

12. Disclaimers and limitation of liability

The site and products are provided "as is" to the fullest extent the law allows. To the fullest extent permitted by law, we aren't liable for indirect, incidental or consequential losses, and our total liability for any claim relating to an order is limited to the amount you paid for that order. Nothing in these Terms limits any rights you have under consumer protection laws that can't be waived.

13. Indemnity

If you break these Terms or the law while using the site, you agree to cover reasonable losses and costs we incur as a result.

14. Governing law

These Terms are governed by the laws of the State of California, USA, without regard to its conflict-of-law rules, except where the consumer laws of your own country or state give you rights that can't be changed by agreement.

15. Changes to these Terms

We may update these Terms from time to time. The version in effect when you place an order applies to that order. The "Last updated" date at the top shows when they last changed.
